The Recreational Vehicle is parked in the
driveway of the residence or in the street in front of the residence and
is present for a maximum of five (5) days in any twenty (20) day period
providing the Recreational Vehicle is owned, operated or leased by a
Resident Member; or the Recreational Vehicle is parked in the
driveway of the residence or in the street in front of the residence and
is present for fourteen (14) days in any thirty (30) day period if the
Recreational Vehicle is owned, operated, or leased by a person who is a
guest of a Resident Member.
ENFORCEMENT
A Resident Member in violation of the CC&Rs will be notified in writing
of the violation. The Resident Member will then have thirty (30) days to
comply.
After the thirty-(30) day grace period, a
fine of $10.00 per day will be imposed for continued non-compliance.
After five months of non-compliance, if
the fine imposed has not been paid, a lien will be filed against the
residence. Notification will be given according to the procedures for
notification in effect with regard to Association liens generally.
After six months of non-compliance,
foreclosure proceedings shall be instituted.
EFFECTIVE DATE
All rules shall apply immediately to any
person, corporation or association that becomes a Resident Member on or
after the day following the adoption of these definitions, rules and
procedures by the JSHOA Board.
Rules 1 and 2 shall not apply to any
person, corporation or association that is currently a Resident Member
on the day of adoption (October 7, 1999) of these definitions, rules and
procedures by the JSHOA Board, so long as that Resident Member shall
park the Recreational Vehicle behind a fence of at least six feet.
All definitions and procedures shall apply
to all Resident Members. |
